Childsupport

I have 1 child with my boyfriend who is currently married to someone else going through a divorce and childsupport with this woman. We sat down and talked and he is willing to complete a notarized letter stating that if we seperate he is willing to pay me X amount of dollars per month in childsupport and have this letter notarized. Can we do this and is this legal in the eyes of the court if we do seperate?

Child support and cutody have to be signed by a Judge to be legal. A notarized letter or contract is not enough in these kind of matters. I just did one in a case similar to yours, i.e., child with married man. We filed a joint petition for support and custody and submitted a stipulation and order for custody and support which the judge signed. That is the legal way to do it. There are certain statutory provisions which must be in the document which you simply cannot do in a letter or contract.
