Re: the prosses of serving legal papers

When serving papers on another person, a process server is required to reasonably determine that the papers will reach the person they are intended for. So, they may be served to the person directly, they may be served at work, at home or on the go. The papers may be given to a wife, or child (which is old enough to understand the repercussions of taking them), but in general they may not be given to a person not authorized to receive process on your behalf.

So if someone served the papers to a co-worker and not you, then you have not been served.

This is an important technical issue, please seek legal assistance in order to address the issue and concerns that you have. Your rights are dependent upon proper action.

DO NOT WAIT.

The process server can leave the papers with a person of suitable age and discretion at your place of work or residence.
