I have a 4 1/2 yr old son and his father has never been around and he is not on the birth certificate. If my boyfriend wants to adopt him after we are married, do we have to go thru a signing off rights for his biological father??

Yes, the Court will require you to either terminate the rights of the father or have the father consent.

You still have to do a voluntary or involuntary termination of the natural father's parental rights in order to do a legal adoption.

Thank you for your inquiry.

Before you would be able to do a legal adoption, you would need to obtain either: (1) the consent of the biological father or (2) a termination of parental rights of the biological father.

If you are unaware of the whereabouts of the biological father you may be able to do a Service by Publication. Upon effective notice a Judge would be inclined to go forward on your adoption.
