Jurisdiction

marrige ended in divorce and sole cuatody of 2 kids; remarried twice; birth dad gave up all rights and kids were adopted by husband #3; divorced in NV; sole custody of kids awarded to mom; mom moved to NC for 2 years; kids stayed for past yr with birth dad (no parental rights) in NC; mom extricated kids with TPO; she and adoptive father signed consent to adopt papers, custody papers etc. and sent kids back to NV to start school and be adopted by her sister (who has been an active part of kids lives since birth (kids actually lived with her sister more time than with birth dad)); (adoptive father has had no contact with kids for 2 yrs, but never gave up parental rights); adoption cannot be finalized for 6 months; birth dad's spouse filed interested 3rd party order seeking custody; kids are 15 and 13 and want to live with mom�s sister in NV; 15 yr old in mental institution over fears of being returned to father in NC; who should have jurisdiction in a complex case like this?

It is hard to fully follow the complex facts of your situation. However, if your children have been living with your sister in Nevada for approximately the last 6 months and have started adoption procedures here, Nevada would have jurisdiction over your matter.
