Legal Question in Family Law in Nevada

Move out of State

Our divorce is not yet final and I want to know what I can--name removed--when we go back to court to stop my soon to be ex-wife from moving out of state with our child.

Move out of State

Nevada law very clearly says that to move a child out of state requires permission of the other parent OR approval of the Court. If your "ex" fails to obtain court approval and moves with the child anyway, it is a basis for the Court to change custody from her to you.

However, if the "ex" has a legitimate reason for moving, her application to move probably will be granted. If that happens, I urge you to seek the advice of an attorney in your community.
