Legal Question in Civil Litigation in Nevada

Yoga Gone Bad

I paid a $500 deposit for a Yoga Teacher Training Program. Then I found out the teacher is 1) Not registered with Yoga Alliance (she is telling all the students she is) 2) she's having an affair with a married man whose wife is now stalking her. So, I told her I do not want to go to her studio any longer because she's a liar and i don't want some crazed, scorned wife coming up there and shooting up the place while i'm there so give me my money back. She says it's non-refundable per her website. Do I have a small claims case? I feel like she is in breach of contract because she's not registered with Yoga alliance and because her website states that for students to be certified they must conduct themselves in an ethical manner and her personal conduct is in direct contradiction to this. Also, an application was required to be filled out prior to the training and I was never provided an application. Does this help or hurt my chances of recovering any money. You can read her teacher training policies at the adiaya website.

Re: Yoga Gone Bad

If she misrepresented herself as a teacher in terms of her training you would have a small claims court case for misrepresentation. Insofar as her affair with a married man and his very upset wife, I don't think that would get you out of your contractual obligation.
