Legal Question in Family Law in New Hampshire

Can he make me move?

My ex agreed that I could move 1hr 45 min. away from him, with the children. He later said ( in court) that he agreed on a temporary basis and now wants me to move closer( within 1hr) of his residence. I am settled with the kids with my boyfriend (for 1 yr.)and he has a business which prohibits him from leaving town. I also would not be able to afford to live with the children on my own, at this time. The judge ordered that I was to use the best of my abilities to TRY to move closer to their father within 6 mnts. IF I DID SO that their father would pay for first and last months rent for me( was father's suggestion). He is now saying if I don't move in 6 months he is taking me back to court to try again to get the judge to MAKE me move. SO my question is ...Can the judge make me move under these circumstances?

Re: Can he make me move?

The direct answer is, "yes." The judge has the authority. However, the judge will take many factors into consideration. The primary consideration is what decision would be in the best interest of the children. I suggest that you focus on why the move would be harmful to the children and how you plan on keeping the children in close contact with their father. I believe that this is a highly fact driven matter and you should consult with an attorney to review the full details of your case.
