Legal Question in Family Law in New Hampshire

moving w/kids out of state with joint custody

My exwife and I have been divorced for 3 years. We have joint custody of our 2 children. I have physcial custody of the children (they live with me) and it was stated in our divorce decree that the children would live with me and she would pay support. I want to move to TN for a better job and way of life for my kids because I can not afford to live here any more-( even if she was paying support). I asked her to let me move and she refuses. Can I just notify her in writing with my intent to move(30 day prior notice). if not do I have to get sole custody of my children in order to move or do I just have to petition the court for permission to move provided its in the best interests of the children.

Re: moving w/kids out of state with joint custody

You will need to petition the court for permission to remove the children from the State fo New Hampshire, and will need to be able to demonstrate the benefit to the children, and be prepared to explain how the other parent's visitation rights can and will be preserved.
