Renting apartment, found out building is being foreclosed, what are our rights??

We have been renting an apartment, always paid rent, no problems.

Now we found out that the house is being foreclosed on because the original owner died, and her children did not pay the mortgage. We have paid them rent as they instructed us to, but they have not paid the bank.

What are our rights?

and how do we handle this, it seems like we have done everything we are supposed to, and have been defrauded out of our rent.

These can be somewhat complex issues. First, you have not been defrauded. You have paid the rent and lived in the apartment. The bank has no claim against you (but you should have copies of checks or receipts.)

If and when the bank forecloses, your rights may be impacted. Did you have a lease for a set term? Does the lease make reference to foreclosure? In many of these cases the bank will notify you after the foreclosure who purchased the property to whom and how to pay the rent if you wish to stay.

Gather as much information as possible regarding the foreclosure and consult with an attorney as to your specific facts and circumstances.
