Legal Question in Real Estate Law in New Hampshire

I am a condominium owner and a member on the board. I am sending out our annual meeting letter, along with my own made up proxy to have unit owners assign another owner to vote on their behalf if they cannot attend the meeting. Does this have to be done legally? If we recieve back all proxies in order to meet our quorum will this be considered a legal vote?

Most questions regarding proxy use are governed by your Condominium Declaration and By-laws and by New Hampshire Statutes, especially RSA 356-B. Condominium law requires that those procedures be followed. Without examining your documents it is impossible to formulate a solid answer. As to the proxy document itself, it does not have to be prepared by a lawyer, but it does have to meet all legal reqirements specified in the Condominium statutes and your Declaration and supporting instruments. Most Condominium Associations find it worthwhile to budget for the assistance of legal counsel in dealing with these matters.
