Legal Question in Real Estate Law in New Hampshire

Purchase property from town via a Tax Deed

Six famlies formed an association and purchased a small piece of land on a local lake. This property was taken over by the town via a Tax deed for non-payment of taxes by previous owner. One of the association members has a Long-Term lease for a dock on this property, which expired last month. We have not renewed this lease and are looking to take over the dock for ''ALL'' members of the association.

Does the town taking over this property by a Tax Deed nullify this lease and if so can we simply send this member a letter stating that the dock now belongs to the association and is available to all of its members.

Thank You

Disgruntled Association President

Re: Purchase property from town via a Tax Deed

I'm a little unclear concerning the facts in your question but as I understand it; your Association bought the property from the town after the town took it for taxes. The lease was in effect before the town took the property. The lease has now expired. If these are the facts, you need not worry about the town's role in all this as the lessor no longer has a valid lease due to the fact that it expired. Send the lessor a letter telling him or her that the dock now belongs to the Association. Good Luck. Let me know if there is anything else I can help with.
