Legal Question in Bankruptcy in New Jersey

Listing all creditors

There is only one credit card that I have that is in collections and it is way over my head financially. I am in good standing with my other credit cards and with my car payements (which is a lease that I co-signed for). Do I have to list all these other cards and my lease if I am up to date and in very good standing with them? I have no problem paying them and would like to continue paying them like I have been. I just want to know if they all have to be listed if I file for bankruptcy.

Re: Listing all creditors

If you have a zero balance on any credit card on the date of the filing of your petition, you need not list them. The leased vehicle can be reaffirmed. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since you have not retained an attorney in this case, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. If you mention LawGuru, there will be no charge for your first consultation. Good luck! Rob Gleaner
