Legal Question in Civil Rights Law in New Jersey

sex offender

My father was charged with a crime he did not commit. With no money nad no lawyers to help he was convicted of sexual assault on a minor in 1985. When he was released in 1990 there where no stipulation for any registy. He did all time served. he has been a remodel to the community a church going man and living by the way of the lord. I 2007 he was notified he had to register as a sex offender. he did comply with the law but he does not qualify to be registered. this happened in nj and he resides in fl. I have a letter from tallahasee that he did not qualify to regtister now they are making him other wise it is a 3rd degree felony. Accourding to nj he would be tier 1 which is just notifying the police but in florida he is mapped out every where. he has a sheriff that checks on him2-3 times a yr to make sure he lives at the address and he has to register in person 2 times a yr.since fl does not have a tier system how is it constitional to put him on this program after all time was served and he was re;ease with no stipulations. how do we go about getting this rectified and himoff this system?please help

You will need a criminal lawyer to try to get a waiver or around this. This is a tough issue and I believe that the coursts have upheld Florida's right to require anyone convicted of a sex crime to register.
