Legal Question in Credit and Debt Law in New Jersey

Collection Law

My mother is paying off two balances of about $800.00 each. She sends the hospital $25.00 a month for each invoice, a total of $50.00 per month. She has already paid a third invoice off. She is on a fixed income and is 73 years old.

The hospital is threating to send it to a collection agency because they want more then a $25.00 per month payment. She is making a good faith effort to pay the bills off. Can they send this to a collection agency even though she is making monthly payments in the amount she can afford ?
