Legal Question in Criminal Law in New Jersey

Charged with 2C:35-10A (4) and 2C:36-2.

I got pulled over for running a stop sign. the cop smelled weed in my car and searched it. Theyfound less than 50 g in zip lock baggies, and a scale. what am I looking at ?

You're looking at only the stop sign violation if you beat the other charges. You may have a good shot at beating the other charges. Despite the odor, the cop's searching of the car without a search warrant may have been illegal. If so, what the cop found can be suppressed, and you walk away from it with only the fee for your attorney.

Frankly, what you are looking at are two disorderly persons charges which carry the risk of 6 months in jail, $1,000 fines, and loss of a driver's license for 6 months. If you are looking for a relatively easy resolution to your problem, and you have never had any drug convictions or diversionary programs in the past, then you can apply for a Conditional Discharge which ultimately would result in a dismissal of the drug and paraphernalia charges against you. If you have a prior drug or diversionary program record, then you are looking at jail time, high fines, loss of driving privilieges, and having a criminal record.
