Legal Question in Criminal Law in New Jersey

drugs

I'm 24 and charged with possession of a controlled substance (percocet 37), posession with the intent to distribute same, and intent to distribute within 1000 feet of a school. All charges are in the 3rd degree. I have no prior record. What could be the minimum I could get?

If you have no priors and a good attorney that can try to get you a preindictment plea you are looking at 3 years 9months without parole. If you go to trial and found guilty the judge will sentence you to 5 yrs 3 yrs without parole. This is a mandatory sentence. You can call my office at 201\646\9600.

A first offender sentenced for committing a third degree crime is protected by the presumption of nonincarceration.

The Minimum you could get would be some amount of probation. However, the MAXIMUM you could get potentially could be over five years in state prison. If convicted of the school zone offense, a state prison sentence is likely. Contact an attorney. Depending on the circumstances surrounding the offense, although remote, pre-trial intervention is a possibility. It has happenned in the past.

I agree with the other responses, that at a minimum you are likely to get probation, and a max sentence will be state prision with parole ineligibility. As a former county prosecutor I am very familar with these types of cases.
