Legal Question in DUI Law in New Jersey

State vs. Chun Question

Can anyone provide an update on this case? I've heard reports that the independent testing has not yet even begun as Draeger is still refusing to turn over the software. Does anyone have a ball park estimate of when this is all going to get sorted out. And why is NJ still using this machine, and letting the number of stays run up ridiculously when the outcome could potentially still be in doubt?

My understanding is that the hearing master, retired Judge King will be conducting a further inquiry as to the manufacturer's information and report back to the Supreme Court at the end of the year.

Some towns are proceeding with the 7110 cases by not using the readings and relying solely upon the officer's

observations of the defendant.

Most people thought this would be over by now. At this point, there is just no end in sight. Whatever happens will cause real problems here. There are 1000's people who have had the DL suspension stayed pending the outcome of this and it keeps building. NJ transit is going to get real crowded at some point. It will be real chaos.
