Legal Question in Family Law in New Jersey

child custody of my runaway daughter

My daugher ran away and is living around the corner at a neighbors home, She was diagnosed with a conduct disorder, and I have had her in therapy etc. She is unsafe to return home with my other 2 kids and I tried for 1 yr to get her help but the agencies are just passing her through the system, I can not take legal responsibilty, while she is not home and she wants to stay where she is, Her father wants custody to leave her where she is, Unfortunally I have no choice, how do I go about doing this, do I need an attorney or do I just go to family court.

Your husband files for custody and you indicate your consent. I assume that you and your husband are divorced which means that the judgement of divorce must be modified. Your huband should go down to the family part at the county court house and talk to them.

Hi,

The child's father should be the person who files a motion with the family court for custody. You can join the application and consent based on a change in circumstances, and the family court will always do what is in the best of interest of the child.

A person can always file what is called a Pro Se motion, without a lawyer. However, you or the child's father would probably be better served with the services of an attorney.
