How long can a default judgement take?

A husband has filed for default judgement becuase wife will not sign the settlement agreement and constantly wants changes to be made above and beyond what is fair. How long can a default judgement take form the date of the first hearing hearing? Since the wife is stalling and being uncooperative, how long will the husband be forced to stay married to her?

It depends on the county. The time that it will take to get this matter scheduled depends primarily on the backlog of cases in the county in which it is pending. hi -

it depends. once you've sent in your request to enter a default, you must then send to her a notice of equitable distribution, if there are marital assets to be distributed. even so, she can still show up on the date set by the court for the hearing and ask that it be postponed, so that she can get a lawyer. if that happens, it's like starting from the beginning...they file an answer, and so forth. feel free to call me at 609 263-0089 if you have any other questions. good luck !
