Re: can i as an individual be sued?

Anyone can file a lawsuit against anyone at anytime for anything. That does not mean they can prevail. In order to protect yourself, you should contact your auto insurer and report this immediately. It certainly does not sound like you should have any personal liability, but you should not ignore this matter.

While you certainly may be sued on a negligence theory, it is most important to immediately report the accident to the insurance company of the owner of the vehicle as well as your own insurance company. As long as you were operating the vehicle with the permission of the owner you are an additional insured under the owner's policy. The insurance carrier must provide you with an attorney and pay any judgment absent any valid exclusions.
