Legal Question in Civil Litigation in New Jersey

Verbal Agreement To Pay Medical Cost

The President of the company stated he would pay my medical cost, after he had called an ambulance assuming I was having a heartattack. I was on the phone calling a friend to pick me up when the paramedics arrived. I was refusing to go stating I believed it was only a pulled muscle and I did'nt have medical insurance yet intended to get medical attention by my own doctor immediately. He argued that I had to go by ambulance and he'd take care of the medical cost, just give his name to the hospital and he'd take care of it. Now when I gave him the bills he stated he only said that to calm me down and would not pay the bill. When I explained I would take him to small claims he now states he might pay some of it no quarentee.

Re: Verbal Agreement To Pay Medical Cost

You can argue that there was an oral contract. This is not always successful, but it is worth a try.

Seems to me that you may have a Workers Compensation claim since you were taken to the hospital from the workplace. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. Good luck! Rob
