Legal Question in Civil Litigation in New Jersey

Liability for minor automobile mishap

While waiting in line (my car was stopped) I accidently ''tapped'' the car in front. The driver asked me to pull over so he could examine his car. I did and he noticed that some paint from my license plate were on his bumper. There was no dent. He now wants $300 from me which is way overkill. I believe it could be removed with some car polish. What recourse do I have. I believe he is being unreasonable. If he won't allow me to remove it should I suggest he bring me to small claims court? It was so minor but it was my fault. Does that give him the right to hose me?

Re: The right to

He certainly does not have the right to hose you and if he takes you to Small Claims Court, he will need to prove the cost of his damages. Make sure you take pictures of the damage and tell him you want to go to an auto repair facility, with him, and get an appraisal of the damage. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, you may want to choose to discuss this with an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010.
