medicare lien in medical malpractice case

Malpractice case is in settlement stages. Doctor admits not reading my mother's CT scan and let throat tumor grow for 7 months. Mom did not have cancer treatment, but chose Hospice care. She died of laryngical cancer. Medicare bills exceed $80,000. Doctor did not cause cancer..he allowed it to grow.

Medicare lien stands in the way of a acceptable settlement.

How can we fight Medicare on this matter? How do I negotiate a lien with Medicare? My lawyer says we have to pay them.
