Legal Question in Personal Injury in New Jersey

Exceptions to Limited Lawsuit Threshold

I accepted a Limited Lawsuit (Verbal) Threshold on my automobile insurance policy. I understand that this limits my ability to sue for noneconomic damages. My question relates to the actually injuries I received in the motor vehicle accident.

I have been diagnosed with compression fractures in the thoracic spine. Under the limitation or lawsuit option, I agreed not to sue unless I sustained such as death, dismemberment, significant disfigurement or scarring, displaced fracture, loss of a fetus, or other reasonable degree of permanent injury. Do compression fractures of thoracic spine fall into any of these categories of injury?

Re: Exceptions to Limited Lawsuit Threshold

Thank you for your inquiry. Such a fracture, in my opinion, would overcome the verbal threshold limits.
