Legal Question in Personal Injury in New Jersey

libel in a book review?

I wrote a book on homophobia which was recently reviewed in a journal. The reviewer didn't like the book, okay. But he to use his own word in reference to the book really ''trashed'' it. This is okay too, only not only did he misunderstand and misquote me he got many of the facts dead wrong. For example he said --name removed--doesn't quote...'' when I did, --name removed--doesn't even mention'' when I did, and the like.

He also used such words as ''sloppy'', ''least qualified'' and so forth, always with a qualifier, however, like possibly.

Can I force the journal to write a retraction (at the very least) and is there a possibility of action for libel. I really think he hurt my book and reputation both

Re: libel in a book review?

I would consider suing the book reviewer and the publication which published the article. If the book reviewer was in error, that would support your case.

If all you want is a retraction, you should have an attorney write a letter pointing out the inaccuracies, and demanding a retraction and/or correction to avoid suit. This should not cost that much in legal fees.

If you want to sue them, consult a few attorneys. Take the one you feel most comfortable with and most certain about his/her abilities. But be forewarned, a suit like this could/would take years to resolve.
