Legal Question in Real Estate Law in New Jersey

How can I get mine and my husband's name released from an old defunct bank loan lien that has been paid of for over 20 years now? We have receipts stating it has been cancelled and paid but none that state 'satisfied'. We are applying for a bank loan. Thank you. Lydia

The bank you are applying to will probably be getting title insurance on the loan. Ask the title insurance company how to locate the agency or bank that took over the old bank's assets. The title company may assist you in having the lien released. Do any of the receipts actually refer to the lien or mortgage and say that it has been released or paid off, and is that receipt signed by an officer of the bank and notarized? If so, that document may be recorded [again, ask the title company] to clear the client.

* If the answers to your question confirm that you have a valid issue or worthwhile claim, your next step should almost always be to establish a dialog with a lawyer who can provide specific advice to you. Contact a lawyer in your county or township.

* Another reason for contacting a lawyer is that it is often impossible to give a good answer in the Internet Q&A format without having more information. The unique circumstances of your situation and things that you may not have thought to mention in your question may completely change the answer. If you want to be sure that you have a complete answer to your question and an understanding of what that answer means, establish a connection with a lawyer who practices in the area of your concern.
