Legal Question in Traffic Law in New Jersey

improper right turn

I was on Rt133 (two lanes in each direction-4 total lanes) heading North. I was trying to make a turn onto Rt571 (two lanes in each direction-4 total lanes) going West in East Windsor NJ. The light was red. The only 2 signs at that intersection say NO LEFT TURN. I moved forward up to the point where I could see all the oncoming traffic. Once I saw that it was clear, I made my right turn. However, because there is a permanent obstruction (a big evergreen tree) on the left-hand-side of Rt133, the turn (due to the turning radius of the car=16.4 feet), placed my car in the more distant lane of Rt 571 instead of the closer lane of Rt571. I received a ticket for an improper right turn. My argument is that Safety First supercedes any traffic law. If I tried to make the turn into the near lane of Rt571, I would not be able to get a good view of the oncoming traffic. Can I win my case?

There is no way to predict what will happen for sure. However, in general I would say no, not even close. You could talk to the prosecutor, see what he/she says and then get an attorney if you don't like what you hear.
