Legal Question in Consumer Law in New Mexico

I have attempted two times to return some items (uncirculated coins) back to a merchant, and the merchant keeps returning these coins back to me, because the ten day time privledge had passed.

The ten day time frame passed because I sent one of the coins to a professional coin grading service, and it took three weeks time.

The coin I sent to be graded was sold to me as a mint state, grade 68 (ms68), and the professional coin grading service graded it as a ms66, and that lowers the monetary value of the coin substantially.

I do not want these coins because I believe, based on the result of the coin that was professionally graded, that all coins are not the exact grades as were sold to me.

Is it possible to legally force this merchant to accept return of these coins, and give me a full refund?

I'm looking forward to your reply.

Thank you,

Johnnie Stephens

This is a classic case for small claims court. Metropolitan Court in Bernalillo County, Magistrate in any other county. They provide the forms. Go through the process and you will get a hearing before a judge who will decide who wins the case. Lawyers not required.
