Child Support

If you are still married and spouse

refuses to give you any money to support our child financially can I sue for child support

In a word, yes. Married people owe a fiduciary duty to each other and to their children. So, if there is only one wage earner in the home that person has a duty to support the other married partner and the children of the relationship. Usually, a married person is separated when they are asking the question you are asking but the fact that you are not separated does not change the answer to your question. You could go to Income Support Division of Human Services Department and see if you qualify for some form of public assistance. If you do and you accept the public assistance then the child support division will do the suing part for the child support on your behalf.
