Legal Question in Business Law in New York

Question on contracts

Hello,

I had a question on contracts being legally binding under 30 days. Im closing my acct for cable and theyre explaining to me Im subject to a cancellation fee even though its only been a week. Is this true? Dont you have to be with the acct for atleast 30 days or submit atleast one payment towards their svce. Please help, thanks.

Re: Question on contracts

It depends on the terms of the contract. The free-pass option on almost any contract is three (not thirty) days in NY. However, utilities (gas, electricity, phone, cable) are Special; they can have some pretty tough clauses in their contracts, and, once you sign on, you're bound by those clauses.

Read your contract carefully; your answer lies therein. If you don't understand all the terms in the contract (and the utilities' lawyers write these things in dense legalese), take the contract to your lawyer and ask for an opinion about it.

Re: Question on contracts

While Ms. Delain's advice makes sense if the fee was several thousand dollars, what are you going to do? Sue your cable company for the hundred dollars? (Or whatever small amount you'll owe them.)

Pay it. Move on to more important things.
