Legal Question in Business Law in New York

Is my website violating copyright?

I started a website, bestpspstore(dot)com , in which I sell Hacked PSPs. These PSPs are customized in software, and are able to play downloaded games. I know this is illegal, but I do not provide any games with the PSP. I do provide programs which are freeware, such as youtube on PSP and snes/gba emulators for psp (again without games).

I also include instructions on how to obtain and put games for PSP and other systems on the PSP, but with the disclaimer that I provide this information with the intent it be used for only for legal downloads, such as non copyright games or games which the owner has the legal right to download (games he has proof of purchase of the physical copy and is downloading only to back it up).

You can check the site out if you need additional details on what I do and do not provide. Am I breaking any copyright laws, or any other legal regulations?

Re: Is my website violating copyright?

Are you doing anything illegal? You betcha! Definitely violating copyright laws by selling hacked PSPs, also likely violating patent laws. Enabling others to violate copyrights? You betcha!

Re: Is my website violating copyright?

You NEED a copyright lawyer; you are walking on what could be a very thin edge. Don't walk; RUN to one. There are many in NYC. The big (or even medium-sized) firms are pretty pricey, but smaller firms or solos should be within a reasonable price range for you.

I repeat; you NEED a copyright lawyer. Hire one tomorrow morning (since it's now after 5 p.m.).

Re: Is my website violating copyright?

In addition to the comments by others, you're almost certainly violating the Digital Millenium Copyright Act.
