Legal Question in Credit and Debt Law in New York

Used car purchase

My husband and I purchased a used Suburban from a private owner about a month ago. The title just came in the mail today. This evening we got a phone call from a buy here/pay here car dealership that says they own the truck. They say the guy we bought the car from owes them money, so they're going to come get the truck. What are our legal rights?

Re: Used car purchase

Is the dealer claiming to own the truck - i.e. it belongs to them or do they claim ownership because they have a "lien" on the vehicle?

Did the title from the private seller show that there was a lienholder - specifically this dealer? If so, and you purchased the vehicle, then you did so subject to the lien, unless the seller provided proof that the lien was satisfied.

Please contact my office directly as I would need more information regarding the title and what rights the dealer is claiming to this vehicle.
