Legal Question in Credit and Debt Law in New York

student loan debt

i had a graudate student loan debt of 67K or so in 1993. I defaulted. Sometimes in 2003, when it wws about 103 K or so, I refinanced my home and upon due diligence , found only one holder, Settled this for 65K and paid a check. In 2004, a year after, I received a call from NYS telling me that I owed them 100K or so. They suggest that Sallie Mae did not have the loas but they did. Since, it's been a nightmare. If I pay NYS, i would be payign double and accounting does not make sense. The docs that they provided are comptuer print outs adn copies of ghe docs that they sent me are duplicates. They have put up collection agent who went into my account and withdrew money on 3 different ocassions. I have tried everything shrot of a lawsuit. Does anyone know what I can do?

You should have received proof that the matter was paid and settled which you should provide to the state or the agency that continues to request payment and you should request reimbursement for any amount paid over your settlement. Depending on who is continuing to request payment and other facts you may consider filing suit to collect these amounts and possibly for other causes of action.
