Legal Question in Criminal Law in New York

I was given a DAT (Desk Appearance Ticket) for 3rd degree assault (misdemeanor) in New York City in 1997. Both sides mutually agreed to dismiss. The case was thrown out. The Judge said the arrest record would be sealed but the BOARD OF EDUCATION terminated my Teaching License immediately after the arrest, before I even went to court. Is it really sealed? How can I get it expunged? Is an arrest record automatically expunged after 10 years? What happens after 10 years?

Ny does not allow for expungement of arrests. Your statute of limitations would have run long ago if this happened in 1997. I would suggest hiring an attorney to assist you in researching this matter. You may contact us at 2124052234

Unfortunately, once you get into the criminal justice system, the arrest never goes away. You should obtain a Certificate of Disposition from the court to prove what happened to the case to show if it ever comes up again.
