Legal Question in Criminal Law in New York

petit larceny charge

I was stopped at Home Depot because they said I was trying to return an item but I had just picked it up. Long story short it was all a misunderstanding Had the receipt and everything They wanted me to sign a form saying I did it I would not sign so they called police who took me down for fingerprints, and pictures. I was released on own recognizance. I have a court date in a few weeks. I dont know what to expect from the court date. Will I be asked to plead guilty or not guilty? I have no record Should they have read my miranda rights? Any info you can give me would be helpful

Thank you

If you have the receipt for the item ,then it appears you have a defense. If not then you perhaps have an opportunity, through a competent attorney,to effectuate a plea bargain. I handle these matters on a regular basis. You may call my office for a free phone consultation@7188340087.

Re: petit larceny charge

You should hire an attorney IMMEDIATELY, a good attorney could make this case go away fairly quickly - otherwise you may be in for a criminal record coming from this misunderstanding. If you can show the receipt, furthermore, you may be able to sue home depot for false arrest.

Contact my office we can help you with this situation and even a possible law suit against the store afterwards. My personal area of specialty is criminal law. You can reach me at the email address provided below or contact me at the office at 2127098303
