Legal Question in Family Law in New York

I am 23 years old and live with my fiance. I am looking into fighting for custody of my younger brothers. Their mother is a drug addict and the kids have been removed from her home and sent to live with our father. Our father is an alcoholic and is mentally and physically abusive to the kids. I have personally been hit by him and have seen him hit my brothers. He is also disabled and cannot work and lives with his 64 year old mother who only makes approximately $12.00/hr. They are currently living in a 2 bedroom mobile home. There are open CPS cases against my father for each of the kids and now the kids have a court appointed legal guardian. Can you please give me the legal advice I would need to win custody of my brothers?

You should immediately file a petition for custody of your brothers in Family Court. You should contact the CPS caseworkers and ask to be interviewed as a resource for custody. Since the children have a law guardian (attorney), you should contact him or her and demonstrate your interest in getting custody. If you need help in Family Court, consult with an experienced Family Law attorney. Good luck!

You should indeed file a custody petition, and then contact the law guardian and caseworker.
