Legal Question in Family Law in New York

adoption possible?

The father of my 3 year old has had no contact with her since she was born. his name does not appear on her birth certificate, nor is he connected with her in any other way, other than biologically. He lives out of state. I am engaged to be married. My fiance would like to adopt my child. what would be involved? would this be a difficult process? would we have to find my daughter's biological father and get his consent? Thank you so much for your help in answering my questions.

Re: adoption possible?

Step-parent adoption can be fairly simple. But the parental rights of the biological father must be terminated. Goto metrospotnyc.com/father and complete the emergency NYC metro form.

Re: adoption possible?

There is a two prong attack to this.

Most absentee fathers are happy to relinquish

because they lose financial responsibility

Most are happy to sign off

If not, the three year absence is also

potential grounds for "dispensing with his

consent", a separate proceeding in the

adoption proceeding

Please feel free to contact 716-235-2560

regarding this as this office is expert

in both proceedings.
