Legal Question in Family Law in New York

Child Support

I have a 1 13 year old daughter by a guy that lives in a different state, he has been sending 25.00 whenever he feels like it. I have never filed child support on him,not even when we lived in the same state, he didn't want his name on the birth certificate. How do I get his name on the birth certificate and file child support on him even though we live in different states.

Re: Child Support

Jurisdiction is the location of the child. Since you are in Buffalo you would file in the Family Court in Buffalo.

You would be filing for 1. An Order of Filiation, 2. Custody and 3. Child Support.

An Order of Filiation is where the Court acknowledges that the respondent is the father of the child. Normally, the Court directs a DNA test.

I do not know about Buffalo, however, in Nassau County you can go to the intake room at the Family Court and the Court will help you prepare the petition.
