Legal Question in Family Law in New York

divorce matter

My fiancee is divorced and has 3 children. he is paying child support and alimony properly and on time. However, because his ex wife is very difficult to deal with he decided not to see the kids for 6 months. He usually saw them every other week for the weekend. The exwife threatens to put a stop on his passport so he cannot leave the USA. he is american citizen and travels on business a lot. Is it even a valid claim? Is there any merit to her threat at all? thnak you

Hi:

Generally, someone should have sufficient grounds for a stop to be put on the passport, ie flight risk, etc. Good Luck

Based on the information that you provided, it is unlikely that ex-wife can put a "stop" on his passport. However, there may be more to the story, and your fiancee should consult an attorney.

Put a stop on his passport for what. First off, she doesn't have the authority, nor does any other individual, to "put a stop" on someone's passport. If, however,he owes child support and the arrears are above a certain amount, then SCU has the authority to do this.
