Legal Question in Family Law in New York

divorce in ny

I have been seperated form my wife since 2006 when i left for iraq with army national guard. She moved in with her mother when i left, and i did not return home due to adultry and three abortions on her part. We have two little boys.She got everyhting when i left. Is she entitiles to half my property now.

What she is entitled to is dependent upon the facts and circumstances of your case. Analyzing it will require many more facts than those posted in your question.

Under equitable distribution, all marital property acquired by you and your wife will be subject to equitable distribution. The exact amount awarded to each spouse will depend on a number of factors, including the contributions made by each spouse, whether either spouse wasted assets, the overal financial circumstances, and so on.

Separate property will remain separate.
