Legal Question in Family Law in New York

I am a non-custodial parent and pay basic child support for my 18 year-old daughter who will be attending full time college. When my wife and i divorced in 1994 NO stipulation or order was made for me to pay college expenses or tuition. can my ex-wife take me back to court to make me pay for college expenses or tuition for my daughter.

No. If there is no provision in either the Judgment of Divorce or Settlement Agreement for the payment of college, there is no requirement that you pay. However, remember that child support continues to age 21 in NY.
