Spouse Overseas, Divorce?

I am seeking a divorce and my spouse

is currently overseas (England as a

college student). She will not be

returning before I leave for the

summer. What are my options?

This is not a problem. Your spouse can be served overseas. However, it will cost a bit more than a regular uncontested divorce. There may also be other options. If you'd like, contact me to discuss.

You can file for a divorce and then have her served in England.

Is your spouse a resident of the US/NY?

If you file for a divorce in late December or early January will your spouse be in the US for the holidays?

You can have her served while she is in the US.

It's relatively easy to handle this sort of situation, if both parties are in agreement and if the overseas spouse has access to a U.S. notary. U.S. consular offices perform notarizations, and many large law firms in the UK have US attorneys who are notaries.
