Legal Question in Civil Litigation in New York

Liability

I live in a sober housing facility. I was placed in a 2 bedroom apartment with another recovering alcoholic. He relapsed, ran from the intensive outpatient program he was in and drank and drugged for 3 days. He made threatening calls to myself and others for allegedly ''ratting'' him out. He claimed to be a Latin King gang member and has a violent history. On the 3rd day, employees of the program we were in returned him to the apartment drunk, angry and with alcohol in his possession. I stayed out of the apartment as much as possible and he continued to drink. On his 3rd night back, he was drunk and I locked my bedroom door and went to bed. He picked the lock at 1 a.m. and he attacked me with two knives. I wasn't hurt. I had him removed from the premises by police. He is currently in jail. I would like to file a suit against the program for putting my own sobriety and my life in jeopardy. Do I have a case?

Re: Liability

Yes you do have a potential case. Given the information you have provided, I think the program should have medically detoxified him and then moved him to a room with a new roommate or not accepted him back at all.

BTW. Do not let any thing or anybody threaten your sobriety. You chose the way you feel. You are not a victim, you are empowered to not accept that someone elses actions can dictate your response.

Hang on to your sobriety with all your might. Do not give this loser or the program the power to take away your life.

Good Luck.
