Legal Question in Immigration Law in New York

Hi,

I am holding a valid L1 visa, working in NY for about 2 years.

My girlfriend, Belarus citizen, is having troubles to get a tourist B1/B2 visa.

Would she be eligible to get L2 visa once we get married ?

If yes, how does this procedure work - regular US consulate petition ?

Yes, she will become eligible for L-2 visa if she is married to a L-1 visa holder who is currenty in status and working for L-1 employer.

When you are married, she will apply for L-2 visa at the nearest US Consulate. Form you she will need ceratin supporting documents, etc.

Assuming that she was denied B2 visa solely for being presumed an intending immigrant, and there are no any inadmissibility issues, she should be able to obtain L-2 visa.

I would need more information regarding your particular case before I could comment on it properly.

However, what I can say is that if she is your wife she would be entitled to apply for a spousal visa.

All visas applications are processed, as you know, at the US Consulate of the country of origin.
