Legal Question in Immigration Law in New York

immigration question.

getting married in december with ecuadorian citizen she entered US via student visa six years ago and has since expired. we are moving a month after we get married in the US. to ecuador. if an emergency came up and i had to return to the US what do i have to do to ensure she would be able to enter the US with me?

She wouldn't be able to return to USA from Ecuador unless she becomes a permanent resident of USA (and her unlawful presence 5-6 years had been waived).

You might want to apply for green card (permanent residence) for her, and to leave only after it's been approved. Otherwise, your wife will not be able to enter the country after she leaves.
