Legal Question in Insurance Law in New York

I am a tow truck driver and have an auto repair shop and dealership. I was moving a vehicle in front of my business/residence. I followed proper procedure by having hazard lights on all vehicles involved and service lights on my tow truck. My wife was directing traffic and my son was sitting in my tow truck. We had a vehicle and the tow truck in one lane and another disabled vechicle in the opposite lane. traficwas stoped other drivers were curteous . One driver whipped past my wife, she could not get him to slow down. He side swiped the disabled vehicle in the opposite lane which i was standing next to working on. I had to jump over the car into the snow bank to avoid being killed. As it was i was brushed by the car. The police officer gave me a ticket for parking on the pavement.

The insurance company for the guy who hit me, paid for the disabled vehicle. They were requiring me to show proof of medical injury, loss of business. I provided an estimate of the towing calls i lost due to being out for a weeks time - emotional distress. My wife and son who saw all this happen are still coping with emotional trauma. The insurance company is dismissing my claims.

What do I do to be compensated?
