Legal Question in Insurance Law in New York

car accident

I was a pedestrian and hit by a vehicle. I just had surgery due to nerve damage.

My question is: do to minimum coverage on insurance, can i also sue the person who hit me personally?

Your lawsuit would be against the owner of the car and the driver. If you have a car of your own, you should also notify your carrier of a potential claim under the underinsured motorist coverage part of your policy.

Yes, you absolutely have the right to file a lawsuit against the owner and operator of the vehicle that hit you for any expenses you may have (medical, lost earnings, out of pocket), as well as for your pain and suffering.
