Legal Question in Intellectual Property in New York

Hello,

I am wondering if it is at all possible that the "hello I'm..." sticker can be copyrighted? (if so what is the easiest/cheapest way to find out).

I would like to use this "sticker"/design as part of my logo and whole marketing theme. If I do so, can I trademark my logo that uses this sticker's design? (basically my logo would be the sticker with my unique business name).

As a Franchise Attorney I can say you can't copyright a few words or a slogan. However, you can trademark your entire logo, including design, that incorporates these words. Trademark registration can be at the state level or federal level. Federal, while more expensive and time consuming, is more desirable as it confers nationwide rights. Consult with a good trademark or franchise attorney in your area for specific advice.
