Legal Question in Employment Law in New York

No Bathroom Use in Employer Building

I work in a small business building with only 2 bathrooms for nearly 30 people. Everyone in the building was told at the begining of one work day that the septic was backed up and there were no bathrooms. Everyone was also told that the septic guy would be coming later in the afternoon to fix the problem. No one was allowed to go home. Is it even legal to make employees work where there is no bathroom?

Re: No Bathroom Use in Employer Building

This probably is not an employment law violation but probably is a health code violation and also an occupancy issue. IF this were to occur in the future someone should make a complaint to the local health department.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
