Legal Question in Employment Law in New York

College Student in Search of Her Money

My previous employer owes me two paychecks (for a total of

$249.01), one of which i received and one that I didn't. They

placed a stop payment on the check that I did receive and they are

yet to pay me they one that I never received. Am I legally

responsible to pay the bank fee ($10.00) for the check that they

placed a stop payment on? What if any legal action can I take

against them inorder to secure my past due wages?

Assuming it was to your bank account you have to pay the fee to the bank (although you can sue your employer for reimbursement later).

As for not being paid wages. If you have proof of the hours worked, you can make a complaint to the Department of Labor.

You can also sue in small claims court, but there, while you could claim the stop payment fee you will not be able to recover triple damages.

Should you like to discuss this or any other legal matter, you can call my office to schedule an appointment for a consultation or in the alternative, I can be reached for on-phone low-cost legal consultation at 1-800-275-5336 x0233699.
